These Terms and Conditions (“Terms”) govern your use of PrivateGP.ie and the healthcare and related services available through the Website.
By creating an account, booking a consultation, submitting a prescription or other clinical request, or purchasing a Service, you agree to these Terms.
Nothing in these Terms excludes or limits any right or remedy which cannot lawfully be excluded or limited under Irish law.
1. About PrivateGP.ie
PrivateGP.ie is operated by Atlantic Maple Private Healthcare Limited, CRO number 799369, a proudly Irish company.
Email: privategp.ie@gmail.com
Website: www.privategp.ie
PrivateGP.ie provides remote healthcare services through doctors who are appropriately registered with the Medical Council of Ireland. Each Doctor remains responsible for exercising their own professional and clinical judgment.
A doctor’s registration can be verified through the Medical Council’s register.
In these Terms:
- “Doctor” means a doctor providing clinical care through PrivateGP.ie;
- “Patient” means the person receiving the healthcare;
- “Service” means a healthcare or related service offered through PrivateGP.ie; and
- “Consultation” includes a clinical assessment carried out by video, telephone, secure messaging, online questionnaire or a combination of these methods.
2. Our Services
Our Services may include:
- online GP consultations;
- prescription and repeat-prescription reviews;
- sick certificates, referrals and medical letters;
- weight-management services; and
- other healthcare services described on the Website.
The description, price and any specific conditions applying to a Service will be shown before you purchase it. Where a particular Service has additional conditions, those conditions form part of your agreement with us and will apply to that Service.
Not every medical condition or request can be safely managed remotely. The fact that a Service is available to book does not mean that it will necessarily be clinically suitable for you.
3. Declaration and Patient Responsibilities
By using PrivateGP.ie, you confirm that you wish to receive healthcare through a remote medical service and accept the responsibilities set out below.
Adults, Parents, Guardians and Children
If you are aged 18 or over, you may use PrivateGP.ie to request healthcare for yourself.
For a child under 16, healthcare should ordinarily be requested by a parent or legal guardian. By booking for a child, you confirm that:
- you are the child’s parent or legal guardian, or otherwise have lawful authority to seek healthcare on the child’s behalf;
- the child’s identity, date of birth and medical information you provide are accurate;
- you will be available to participate in the Consultation where required;
- the child will be available to be seen or spoken to if the Doctor considers this necessary; and
- you will provide reasonable evidence of your identity, relationship to the child or authority to consent if requested.
We may pause, decline or discontinue a Service where parental responsibility or authority to seek treatment is unclear or disputed.
The Doctor will involve the child in decisions about their care to an extent appropriate to their age, maturity and circumstances. Exceptional circumstances involving a child under 16 will be managed in accordance with applicable law, professional guidance and the child’s best interests.
A young person aged 16 or 17 may consent to medical treatment in their own right where legally and clinically appropriate. Their confidentiality will be respected in accordance with applicable law and professional guidance. Involvement of a parent or guardian may be encouraged where appropriate and with the young person’s agreement, although there are circumstances in which different legal or safeguarding requirements may apply.
Some Services may have additional age or parental-involvement requirements because of their nature.
If you wish to arrange healthcare for an adult who may not be able to make or communicate their own healthcare decisions, please contact us before booking so that the appropriate consent and decision-support arrangements can be considered.
You must not falsely represent yourself as a Patient’s parent, guardian or authorised representative or request healthcare in another person’s identity.
Identity, Location and Account Security
Unless PrivateGP.ie expressly confirms otherwise, the Patient must be physically located in the Republic of Ireland when medical care is provided.
We may require reasonable verification of identity, age, location or other information before providing a Service. During consultation you should ensure that you are in a private location.
Information You Give Us
You confirm that information you provide to PrivateGP.ie and its Doctors will, to the best of your knowledge, be truthful, accurate, complete and up to date.
This includes information supplied through booking forms, questionnaires, messages, email, telephone and video Consultations.
You must disclose relevant information about your:
- current symptoms and medical history;
- allergies;
- current and recently used medication;
- previous treatment;
- pregnancy or breastfeeding status where relevant;
- relevant investigations or test results; and
- any other matter reasonably requested by the Doctor.
Doctors make clinical decisions using the information available to them. False, misleading, withheld or materially incomplete information can make remote medical care unsafe and may result in a Service being declined or discontinued.
Understanding and Following Advice
If you are uncertain about a question asked during an assessment, or do not understand a diagnosis, recommendation, medication instruction or other advice, you should ask the Doctor for clarification.
You agree to:
- follow medication and treatment instructions;
- complete recommended monitoring, investigations and follow-up;
- arrange face-to-face or further medical assessment when advised;
- seek further medical attention in- person if your symptoms worsen, persist unexpectedly or materially change; and
- seek medical advice if you experience significant or unexpected side effects or other concerns relating to treatment.
Medical advice is based on the information and circumstances available at the time it is given. If your condition changes, earlier advice may no longer be appropriate.
Services that are offered through Gaeilge are offered in good faith only in the interest of supporting speakers of Gaeilge to use their native tongue. No guarantee is made that the entire consult will take place wholly through Gaeilge but PrivateGP.ie will endeavour to ensure that the Doctor providing this service will have the ability to speak Gaeilge to a conversational standard. The Doctor will clarify if necessary for safe and best care certain technical, scientific, medical or other terms by using the English Language as the Doctor feels appropriate, and any letters or prescriptions provided will usually be in English as we cannot guarantee that the recipient will have the gift of Gaeilge. No refund is available for use of English by the doctor during consults which use both English and Gaeilge. At the time of writing this is first such service offering a range of remote- only medical services through Irish as well as English.
Medication
Medication prescribed through PrivateGP.ie is prescribed only for the named Patient.
You must not share, transfer, sell or otherwise supply prescribed medication to another person.
Before using prescribed medication, you should follow the instructions provided by the Doctor and pharmacist and read the pharmacy label and manufacturer’s Patient Information Leaflet.
4. Not an Emergency Service
PrivateGP.ie is not an emergency or urgent-response service.
If you believe that you or another person may be seriously or critically unwell, call 999 in Ireland or 112 from Ireland or anywhere in the world and or attend the nearest Emergency Department.
Examples include severe chest pain, serious difficulty breathing, choking, signs of stroke, loss of consciousness, severe bleeding, a severe allergic reaction, serious injury trauma or burns, seizure, significant eye injury, or any other condition requiring immediate medical attention.
Forms, emails, messages and clinical requests submitted through PrivateGP.ie may not be reviewed immediately.
Do not wait for a response from PrivateGP.ie where urgent or emergency medical attention may be required.
5. Limitations of Remote Healthcare
Remote healthcare can safely manage many conditions, but it cannot always replace an in-person medical assessment.
A remote Doctor by nature of the service may be unable to perform a complete physical examination, obtain reliable vital signs or arrange immediate diagnostic testing.
The Doctor will decide whether there is sufficient information to assess and manage you safely through the Service.
If remote care is not sufficient or appropriate, you may be advised to:
- attend your own GP or another healthcare professional;
- attend an urgent-care service or Emergency Department;
- undergo blood tests, imaging or other investigations via an in- person doctor; or
- arrange further or face-to-face medical review.
A Consultation does not guarantee that a diagnosis can be reached or that medication, a certificate, referral, investigation or particular treatment will be provided.
If further or urgent assessment is recommended, you are responsible for arranging and attending that assessment.
6. Prescriptions and Medication
A Consultation or prescription request does not guarantee that a prescription will be issued.
A Doctor will prescribe only where they consider that they have sufficient knowledge of the Patient’s condition and that the proposed treatment is clinically indicated, safe and appropriate.
A Doctor may decline a prescription request where, for example:
- there is insufficient clinical information;
- the requested treatment is not appropriate or safe;
- monitoring, investigations or examination are required;
- the medication is unsuitable for remote prescribing;
- there is a concern about interactions, contraindications, dependency or misuse; or
- another treatment or an in-person assessment would be more appropriate.
Previous use of a medication, or the fact that it has previously been prescribed by PrivateGP.ie or another healthcare professional, does not create an entitlement to a further prescription.
Certain medicines, including controlled or dependence-forming medicines, may not be available through particular PrivateGP.ie Services or may require additional safeguards, medical records, monitoring or face-to-face assessment.
Where a requested treatment is declined, the Doctor will, where appropriate, explain the clinical reason and advise you about suitable alternatives or next steps.
Where clinically appropriate, a prescription may be transmitted securely to a pharmacy.
Unless expressly stated otherwise, medication and pharmacy charges are not included in the PrivateGP.ie fee.
The dispensing pharmacy acts independently and is responsible for dispensing medication. PrivateGP.ie cannot guarantee the stock, brand, retail price or dispensing time of a medicine at a particular pharmacy.
7. Weight-Management Services
Eligibility for weight-management medication or any particular treatment is not guaranteed.
A Doctor may require information including your medical history, medication, height, weight, previous treatment, relevant investigations and other clinical information before determining whether treatment is suitable.
Treatment may require ongoing consultations, measurements, blood tests or other monitoring.
A Doctor may change, pause or discontinue treatment where this is clinically appropriate.
PrivateGP.ie does not guarantee a particular medication, dose, rate or amount of weight loss, treatment outcome or continued availability of medication.
Clinical and prescribing decisions are made independently by the treating Doctor and must not be influenced by commercial considerations.
8. Certificates, Referrals, Investigations and Follow-Up
A request for a sick certificate, referral, medical letter or other document does not guarantee that it will be issued.
A Doctor will issue a certificate or medical document only after sufficient review of the Patient’s condition and where there is an appropriate clinical basis for doing so.
The Doctor determines the appropriate contents, dates and duration of any document. A request from a Patient, employer or other third party for particular wording or dates does not bind the Doctor.
PrivateGP.ie cannot guarantee that an employer, insurer, airline, educational institution, public authority or other organisation will accept a particular medical document.
Where a referral is provided, the referral itself does not mean that an appointment with the receiving service has been arranged. You are wholly responsible for arranging any appointments, in- person consultations or hospital visits that are recommended to you verbally or in writing for example by provision to you of a referral letter.
Where a PrivateGP.ie Doctor advises any investigation, you remain responsible for attending an in- person medical service to arrange ordering, completion and follow- up of the advised investigation.
If an investigation is arranged independently by you or another healthcare provider, PrivateGP.ie is not the responsible doctor for reviewing the result. The PrivateGP.ie Doctor may however provide you with advice, opinion or second opinion if you wish to avail of this during consultation.
9. Your Usual GP and Continuity of Care
PrivateGP.ie is intended to complement appropriate continuing healthcare rather than replace the role of your usual GP where ongoing care is required.
You are advised to continue or arrange care with your own GP or specialist, particularly for chronic, complex or ongoing conditions.
As the PrivateGP.ie Doctor is not your usual doctor, an appropriate clinical update may be sent to your GP to support continuity of care.
We may ask you for your GP’s details for this purpose.
You should also tell other healthcare professionals involved in your care about relevant medication, treatment and advice received through PrivateGP.ie.
If you do not consent to communication with your GP, this will be respected except where disclosure is otherwise permitted or required by law. This may include such cases as where it is in your best interests to allow the Doctor to share consultation information with your regular GP.
A Doctor may also decide that a particular treatment or service cannot safely be initiated or continued without appropriate communication or coordination with your other healthcare providers. For example, an update to your GP is necessary particularly in most cases where a referral letter is to be provided to you.
10. Appointments, Response Times and Technology
We aim to provide Services within the timeframes shown on the Website, but exact response or appointment times cannot be guaranteed.
Doctors may occasionally be delayed because another Patient requires additional clinical attention.
PrivateGP.ie relies on internet connections, telecommunications systems and third-party technology. Electronic requests and communications may occasionally be delayed, interrupted or fail to reach their intended recipient.
If you do not receive an expected booking confirmation, response or other important communication, you should contact us rather than assume that it has been received or reviewed.
You are responsible for having a suitable device, telephone or internet connection and a sufficiently private environment in which to participate in a remote Consultation.
If a technical problem prevents a Consultation from being completed, we will make reasonable efforts to reconnect, use another clinically appropriate method or make reasonable allowances to support you to rearrange the Consultation. If technical issues with your communications systems prevent the consultation from taking place successfully then you will still be charged for the consultation and it will be considered non- refundable.
Do not rely on technological or electronic communications with PrivateGP.ie for emergency medical care.
11. Fees, Payment and Booking
The price of a Service will be displayed before you purchase it.
Unless otherwise stated, prices are in euro.
By submitting payment details, you confirm that you are authorised to use the payment method provided and authorise us to charge the stated fee.
Payments may be processed by a secure third-party payment provider. PrivateGP.ie does not ordinarily store complete credit or debit card information.
Unless otherwise stated during the booking process, a paid booking or clinical request is accepted when payment has been successfully authorised and we issue confirmation of the booking or request.
The fee is charged for the healthcare assessment or Service described at the point of purchase.
Payment does not purchase or guarantee a particular diagnosis, prescription, medication, certificate, referral, investigation or treatment outcome.
Charges imposed by pharmacies, laboratories, hospitals, specialists or other independent providers are separate unless expressly stated to be included.
12. Cancellations, Rescheduling and Refunds
Scheduled Consultations
A scheduled Consultation may be cancelled or rescheduled without charge if you give us at least 3 hours’ notice before the appointment begins.
If you cancel or request to reschedule within 3 hours of the appointment, the fee will ordinarily be non-refundable.
An appointment booked less than 3 hours before its scheduled start time falls within this cancellation period from the time it is booked, unless different terms are displayed when booking.
If you do not attend, the Consultation fee will ordinarily be non-refundable.
If you arrive more than 10 minutes late, or sufficiently late that the Doctor cannot safely and reasonably complete the Consultation in the remaining time, the appointment may be treated as a missed Consultation.
If technical difficulties prevent the Consultation from taking place or being completed, we will make reasonable efforts to reconnect, continue using another clinically appropriate method. If technical issues with your communication systems prevent satisfactory completion of the Consultation no refund will be issued. Where the Service cannot reasonably be provided because of a technical problem for which PrivateGP.ie is responsible, you will be offered an alternative appointment or a refund.
Same-Day or Immediate Services
For Services intended to be reviewed on the same day, cancellation may not be possible once a Doctor has been allocated or has started reviewing the clinical information supplied.
Prescription and Other Clinical Review Services
The fee for a prescription or other clinical-review Service covers the Doctor’s assessment. It does not purchase or guarantee a prescription, treatment or other requested outcome.
A request may be cancelled for a full refund at any time before substantive clinical assessment has begun.
If, after reviewing your request, the Doctor considers the requested medication or treatment to be unsafe, unsuitable or not clinically appropriate, the Doctor may offer an appropriate alternative where available. If the Doctor consider it to be appropriate and in the interests of meeting your care needs efficiently and safely then the Doctor may contact you to clarify any additional clinical information needed. If no appropriate treatment can be provided through the Service, the relevant clinical-review fee will be refunded.
If the Doctor determines that a full GP Consultation is required before the request can be safely assessed or treatment considered, you will be notified of this and you may choose either to apply the amount already paid towards the cost of that Consultation; or receive a refund of the clinical-review fee.
If the Doctor determines that remote assessment itself is unsuitable for your medical needs, you will be advised to seek appropriate face-to-face care and the relevant clinical-review fee will ordinarily be refunded.
If additional medical information is required to complete your assessment, you must provide it within 72 hours of being asked. If you do not provide the requested information, or the information supplied remains materially incomplete or inaccurate, the request may be closed. Where substantive clinical assessment has already taken place, the fee may be non-refundable.
Where a prescription or other requested treatment has been appropriately issued following clinical assessment, the fee is non-refundable simply because you later decide not to use the prescription or treatment, or because a pharmacy is unable to supply a particular brand, dose or product.
Nothing in this section limits any statutory right or remedy which applies to you.
Incorrect Service Booked
If you accidentally purchase the wrong PrivateGP.ie Service, please contact us as soon as possible and we will endeavour to help you.
Where substantive clinical work has not yet begun, we may transfer the amount paid towards the appropriate Service or provide a refund where appropriate.
Where substantive clinical assessment has already been carried out, any refund or credit may take account of the Service already provided.
Cancellation by PrivateGP.ie
If we are unable to provide a paid Service, you will be offered either an appropriate alternative or a full refund.
Approved refunds will be returned to the original payment method. Although we will endeavour to initiate refunds promptly, please allow up to 14 days for refund. The time taken for funds to appear may also depend on your bank or payment provider.
Nothing in this section limits any statutory right or remedy which applies to you.
13. Privacy, Medical Records, Confidentiality and Safeguarding
PrivateGP.ie will handle personal and health information in accordance with applicable data-protection law, professional duties of medical confidentiality and our Privacy Notice.
Medical records will be created and retained as required for safe healthcare, continuity of care and applicable professional and legal obligations.
Relevant information may be securely shared with your GP, pharmacist, laboratory, specialist, referral provider or another member of your healthcare team where appropriate for your care and in accordance with applicable confidentiality requirements.
Medical confidentiality is not absolute. Information may be disclosed without consent where disclosure is required by law in certain circumstances or is otherwise permitted in accordance with professional obligations, including in circumstances involving a serious risk of harm or safeguarding concerns.
Where a Doctor has reasonable grounds for concern about the welfare or safety of a child or another person at risk, the Doctor will be required to act on that concern and make an appropriate referral or report.
You are responsible for keeping your contact information accurate and checking communications concerning your healthcare.
Further details about how personal data is collected, used, stored and shared are contained in the PrivateGP.ie Privacy Notice.
14. Conduct and Proper Use of PrivateGP.ie
Patients have the right to be treated with dignity and respect. Our Doctors and staff have the same right.
You must not:
- use PrivateGP.ie for fraudulent, unlawful or deceptive purposes;
- impersonate another person or falsely claim authority to act for them;
- knowingly provide false medical information or documentation;
- attempt to obtain medication or medical documentation dishonestly;
- misuse our booking, prescription, payment or communication systems; or
- behave towards Doctors or staff in an abusive, threatening, harassing, discriminatory, sexually inappropriate or intimidating manner.
A Doctor may end a Consultation if a Patient’s behaviour or condition prevents a safe and meaningful medical assessment, including where a Patient is significantly intoxicated or unable to participate appropriately or where it is deemed the Patients behaviour is inappropriate.
Serious or repeated misuse may result in access to PrivateGP.ie being restricted or terminated.
If you wish to make an audio or video recording of a Consultation, you should explicitly tell the Doctor. Requests to record will be managed in accordance with applicable law and professional guidance.
15. Website Content, Third Parties and Intellectual Property
We take reasonable care to ensure that information published on PrivateGP.ie is accurate and current. Nevertheless, healthcare information and our Services may change and occasional errors, omissions or outdated material may occur.
General health and medical information on the Website is provided for educational and informational purposes only. It is not a substitute for individual medical assessment and should not be treated as personalised medical advice or a diagnosis.
To the extent permitted by law, PrivateGP.ie is not responsible for loss caused solely by reliance on general Website information rather than appropriate individual medical advice.
The Website may contain links to websites or services operated independently by third parties. We are not responsible for independent third-party content or services outside our reasonable control.
Unless otherwise stated, the Website’s content, design, branding and other intellectual property are owned by or licensed to PrivateGP.ie.
You may use Website content for personal, non-commercial purposes. You must not reproduce, sell or commercially exploit it without permission except where permitted by law.
16. Liability and Your Legal Rights
Doctors providing care through PrivateGP.ie owe Patients the same professional standards and duties of care that apply when medical care is provided face-to-face. The remote nature of a Consultation does not reduce those professional obligations.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence; liability. Nothing in these terms excludes or limits a Doctor’s professional obligations to a Patient; or PrivateGP.ie’s obligation to provide Services with the care and skill required by law; or any consumer or other legal right which cannot lawfully be excluded or restricted.
PrivateGP.ie and its Doctors are entitled to make clinical decisions using the information reasonably available to them at the time of the Consultation or clinical assessment.
Except for obligations imposed by law and the professional duties owed by our Doctors, PrivateGP.ie does not make any guarantee or representation that use of the Service will result in a particular diagnosis, treatment, prescription, referral, certificate, clinical outcome or improvement in symptoms. Medical advice and treatment are based on the individual circumstances and information available at the time, and no medical service can guarantee a particular result.
We do not warrant that every medical condition will be capable of being safely assessed, diagnosed or treated through a remote Service. Where a Doctor considers that remote assessment is insufficient or inappropriate, further investigation, face-to-face assessment or treatment through another healthcare provider may be recommended.
To the extent permitted by law, PrivateGP.ie will not be responsible for loss to the extent that the loss was caused or materially contributed to by:
- deliberately false, misleading or materially incomplete information supplied by or on behalf of the Patient;
- failure to disclose relevant medical information;
- failure to follow medical advice or treatment instructions;
- failure to complete recommended investigations or monitoring;
- failure to obtain follow-up, face-to-face or urgent medical care when advised;
- misuse, sharing or unauthorised use of prescribed medication; or
- events or failures outside our reasonable control.
PrivateGP.ie is not responsible for the independent acts or omissions of pharmacies, laboratories, hospitals, specialists or other third-party healthcare providers, except where responsibility arises from something PrivateGP.ie itself has done or failed to do.
To the extent permitted by law, PrivateGP.ie will not be responsible for indirect or consequential commercial losses which were not a reasonably foreseeable result of a breach of our obligations, including loss of business, revenue or opportunity.
Remote healthcare has unavoidable limitations. These limitations do not reduce the standard of care owed to a Patient, but neither PrivateGP.ie nor its Doctors can guarantee that remote assessment will identify every condition or remove the need for subsequent face-to-face medical care.
Nothing in this section affects any statutory right or remedy available to you under Irish law.
17. Complaints, Changes to These Terms and Governing Law
If you are dissatisfied with any aspect of PrivateGP.ie, please contact:
Please provide enough information for us to understand and investigate your concern.
Complaints will be considered fairly and appropriately. Clinical complaints will be handled in accordance with applicable professional obligations.
Using our complaints procedure does not prevent you from exercising any right to complain to an appropriate professional, regulatory or consumer body or from exercising any legal right available to you.
We may revise these Terms where appropriate to reflect changes to our Services, law, professional guidance, technology or business operations.
The current version and its effective date will be published on the Website. Changes will not retrospectively remove rights which have already arisen in relation to a Service you have purchased, unless a change is required by law.
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
These Terms are governed by Irish law. Subject to any mandatory consumer rights or jurisdictional protections which apply, disputes relating to these Terms or PrivateGP.ie will be subject to the jurisdiction of the Irish courts.
